Alberta Carbon & Energy (ACE) Group Competition Guidelines

  

The Alberta Carbon and Energy (ACE) Group is a networking and discussion group with members from a variety of companies which follows the Competition Bureau of Canada principles and practices pertaining to Trade Associations to prevent anticompetitive effects due to the involvement of competing market participants.

  • Agendas will be provided in advance of all ACE meetings.
  • Members should use caution when participating in ACE events and be alert to the types of discussions that may raise concerns.
  • If a member feels improper discussions have arisen, they should leave the meeting and report the incident as recommended in their corporate compliance program.
  • Members understand that discussing sensitive competition issues with other ACE members that relates to pricing, markets, production levels, customers, bidding situations and other competitive information may be anti-competitive and possibly illegal.
  • Members are encouraged to consider obtaining internal corporate legal advice before participating in ACE and completing competition law compliance training.

 Meeting Principles:

  • No discussion will occur in relation to pricing, profit margins, terms of sale, costs, proposed bids, or other competitive information for any product.
  • No discussion will occur in relation to any information that is material to carbon or energy trading activity in any market. For example: non-public outage information, trading strategies, proprietary price forecasts, and specific portfolio requirements.
  • Customer information will not be discussed, in particular discussions of dividing up customers, markets or territories.

These meeting principles apply to attendees at all times, including in particular breaks and periods before and after meetings.
